Five Miami-Dade and Broward Residents Killed in Fatal Car Crash

Five Miami-Dade and Broward Residents Killed in Fatal Car CrashReported on February 6, 2017, that five people were killed in a three-car crash on a Sunday morning. The car accident occurred on U.S. 1 in Flagler County around 11:30 am. The Florida Highway Patrol report showed that a 2008 Mazda Tribute and a 2000 Ford F-250 truck collided at an intersection. The Tribute turned in front of the truck. The accident killed all five people in the Tribute and injured two passengers in the truck. The movement of the car and the truck caused a collision with a third vehicle. The driver of that third vehicle was also injured.

All five occupants of the Mazda Tribute were killed on impact. The driver and passengers who were killed ranged from 53 to 74 years of age. They had lived in Pembroke Pines, Miami, and Miramar, Florida.

This type of accident raises multiple legal issues

In an accident like this, the families of the passengers of the Mazda Tribute would have the right to bring a wrongful death action against the Estate of the driver of the Mazda Tribute. When someone wrongfully dies because of the negligence of someone else, the spouse, children, parents, and relatives who depended on the deceased may have the right to hold the careless person liable. Wrongful death damages include:

  • The loss of support, services, and guidance the deceased would have provided.
  • Wages the decedent would have earned had he/she survived.
  • Mental anguish of the family members.

The passengers in the second vehicle who were injured and the driver of the third vehicle will also have the right to sue the Estate of the driver of the Mazda Tribute. The incident also illustrates how deadly collisions between cars and trucks can be. Cars are simply no physical match for the size and weight of a truck.
